Nertea, as the owner of the copyright, can freely do whatever he wants with the assets, including putting them into a game owned by his employer, for profit, under a completely different license owned by said employer. Those parts are still available to the public (albeit likely in an older form) under the old license, but any new iterations of the parts would be under whatever license Nertea (or Take Two, or whoever now owns them) chose to release them.
