NASA are quite strict about this stuff: it belongs to them! In the past they have sued for return of similar memorabilia, such as a camera that went to the moon, was supposed to be left behind, but was brought back by one of the astronauts.

That depends on the item, and whether or not it was legally and legitimately disposed of. I.E. if something that belonged to the government was properly sold at auction, then NASA doesn't have a leg to stand on.
