Contract ambiguity - "in flight above XXX metres"

I think the upper limit is the top of the atmosphere - i.e. you have to be "in flight" rather than in space, but other than that, that's it.

So far as I can see, all of these contracts are just either above or below some limit (unlike the older FP contracts which did have narrowly defined windows)

Nope, there's no upper limit - you can do them from orbit. Not only that, you can do them from high orbit! (This however requires some very precise navigation - even on the Mun.)
